Gay Rights Supporters Filed Friend of the Court Brief in Prop 8 Case

Lambda Legal, the National Center for Lesbian Rights, the ACLU of Northern California and Equality California filed a friend of the court brief urging the U.S. District Court not to vacate last year’s historic ruling invalidating Proposition 8. As you know, Proposition 8 was a California ballot measure that served to prevent gay marriage. It will be some time before the matter is finally resolved by the courts.  Opponents of gay marriage have called Judge Walker’s sexual orientation into question and have asked that his ruling be vacated due to bias.

The brief argues:

“It is incorrect—and deeply offensive—to suggest that a judge’s sexual orientation would
determine how he or she would rule in a case involving claims of sexual orientation discrimination,
just as it would be offensive as to suggest that a judge’s race or sex would determine how he or she
would rule in a case alleging race or gender discrimination.”
